The Department of Labor yesterday published the poster which employers are required to post about the Families First Cornavirus Response Act. Employers with fewer than 500 employees are required to post this as they would other employment posters – in a conspicuous location where it will be seen by employees (like a break room or above a time-clock, etc.). Because many employees are now teleworking during the pandemic, employers may email or mail it to them. Employers are not required to provide it to job applicants or employees who have been laid off because they are not covered by the Act. Employers would be required to provide it to new hires.
It does not discuss any of the exemptions for small employers or employees who are healthcare providers or emergency responders. It does make clear that it only applies if the employee cannot work or telework.
